1. GENERAL OBJECTIVES AND CONSIDERATIONS

These General Conditions are intended to regulate the Terms and Conditions under which the website www.casusab.pt, owned by Casus Azorean Business, headquartered at 15 Rua Campo São Francisco, referred to as Casus Azorean Business, will be governed.

The presented Terms and Conditions apply to the relationship between the visitor, hereinafter referred to as the Client, and Casus Azorean Business, the functionalities and rules of the website, and the rules concerning the stay, including operation, hours, and services provided, as well as other relevant information.

The use of the Casus Azorean Business website implies the full acceptance and agreement of all parameters present in the described Terms and Conditions, as well as the Privacy and Cookies Policy in force as presented on the website. If you do not accept, either partially or in full, any of the stipulated conditions, you should not take any action on the website.

Casus Azorean Business reserves the right to update, alter, delete, or exchange any content of the Terms and Conditions, as well as the website, without prior notice. It is advisable to periodically check the Terms and Conditions for any changes or updates.

In situations not covered by the Terms and Conditions, applicable legislation shall be referred to.

 

2. PRICES

All prices on the website are presented per property and room for the entire stay, including VAT and all taxes, unless otherwise stated on the site or in the confirmation email. Occasionally, more economical rates may be available on our website, depending on different variables such as the number of people, selected package, or stay period. Please carefully review the room description and rate before making your reservation.

The price of the stay to be paid by the Client constitutes the consideration for the use of the accommodation during the period between arrival and departure.

Published prices may be subject to change without prior notice.

No charge is made for the stay of children up to 2 years old, as long as they stay in the adults’ room responsible for them. Casus Azorean Business must always be informed of the inclusion of a child in the reservation in order to make accommodations if necessary.

For children aged between 2 and 12 years old, 50% of the value for an extra bed will be charged, provided they are sharing a room with the responsible adults.

It is the sole responsibility of the Client to inform Casus Azorean Business of the number of people (adults and children) who will occupy the accommodation.

In the event that more people arrive than stipulated in the reservation, the Client’s entry may be refused without any refund.

 

3. CHECK-IN AND CHECK-OUT

Casus Azorean Business provides accommodation from 3:00 PM on the arrival date.

Upon check-in, the Client must identify themselves and provide their identification documents, namely identity card or passport.

The Client must vacate the accommodation of people and belongings and without any damages by 12:00 PM on the departure date.

If the accommodation is not vacated by the time defined in these Terms and Conditions, and without any justification or prior consent from Casus Azorean Business, a compensation corresponding to the price of one night will be charged, and the Client will only have the right to use the accommodation during that period if it is available.

 

4. SERVICES

Casus Azorean Business provides the following services to its Clients:

  • Reservation Management
  • Marketing/Advertising/Image
  • Laundry and Cleaning
  • House Preparation

 

5. PAYMENT TERMS

The payment for the accommodation during the stay and other services must be paid at the time of confirming the reservation.

This amount, as well as the cancellation fee, will be mentioned at the time of reservation and may vary depending on the promotional rate or the type of accommodation chosen by the Client.

Casus Azorean Businessaccepts the following forms of payment:

  • Credit Card: With this payment method, you will be asked to provide your card details to guarantee your reservation. All payments will be processed securely, and the handling of provided data will be confidential and non-transferable. Credit card charges will be made solely by Casus Azorean Business. Casus Azorean Business undertakes to respond to any request made by the cardholder within a maximum of two days. Casus Azorean Business recommends keeping a copy containing the transaction details for future reference if needed. The transaction will be processed by the Stripe company after confirming the reservation, at which point the respective digital voucher with detailed information will be sent. Casus Azorean Business ensures the refund of the reservation value in case of valid consumer withdrawal, if applicable, as defined in Consumer Defense legislation.
  • Multibanco: When selecting this payment method during the reservation, a Multibanco reference will be automatically generated and provided to the customer in the reservation confirmation email. This payment method requires payment within 24 hours after its completion; otherwise, it may be canceled by Casus Azorean Business. This payment method is valid only for Portugal.

 

6. CANCELLATION POLICY

The cancellation policy is common to all reservations made on the website and applies to all reservations with a mandatory deposit.

  • If you do not check in at the accommodation on the first day of the reservation without alerting, Casus Azorean Business reserves the right to cancel your reservation and may apply a penalty of up to 100% of the reservation.
  • For modifications to the reservation, fees may apply.
  • In case of cancellation or no-show at the accommodation, the full amount of the reservation will be charged.
  • Rules and Delivery Deadlines: Casus Azorean Business undertakes to provide the contracted service, as well as the respective digital voucher, as soon as the reservation process is completed, within a maximum of 24 hours. Casus Azorean Business gives the Client the possibility of canceling the reservation by exercising the right of withdrawal, in accordance with the legal period (14 calendar days), without any justification or cost. Casus Azorean Business undertakes to refund the amount charged in case of a cancellation validated by the previous point.
  • Without prejudice to the general conditions and cancellation policy already described, specific conditions indicated in the reservation voucher may apply.

 

7. COMPLAINTS ABOUT MATERIAL DEFECTS

The Client must inspect the room upon arrival and immediately report any defects found at the hotel reception.

Any defects that arise during the stay must be reported as soon as the Client becomes aware of them.

If a defect is indeed present in the Client’s room, Casus Azorean Business has the right to choose between repairing it and relocating the Client to a room of at least the same category contracted with the Client.

For the aforementioned purposes, only serious defects that may compromise the level of service and quality will be considered, and Casus Azorean Business is not obliged to take any action in the case of irrelevant or unreasonable complaints or those that relate to details that do not conflict with the minimum level of contracted service.

If Casus Azorean Business is unable to repair the relevant defect or replace the Client’s room with another of equivalent or superior category, the Client may only terminate the contract and receive the price paid for the room, with no further claims against Casus Azorean Business, for any reason whatsoever.

 

8. CASUS’ RESPONSIBILITY

Casus Azorean Business is responsible for ensuring the appropriate conditions of hygiene, cleanliness, and safety of the accommodation.

Casus Azorean Business is not responsible for personal belongings that may go missing within the hotel.

 

9. RIGHTS AND RESPONSIBILITIES OF THE CLIENT(S)

Client’s Rights

  • Confidentiality by Casus Azorean Business regarding the use of the personal data of the Client(s).
  • Tidiness and cleaning of the accommodation.
  • (Quality and efficient service)
  • Complaints requests attended to appropriately and within a reasonable timeframe.
  • Treated with respect and courtesy by Casus Azorean Business and its employees.

Client’s Responsibilities

  • Respect the rules established by the collaboration in complying with these Terms and Conditions.
  • Honor the personal dignity of Casus Azorean Business employees, guests, and/or others.
  • In case of theft, property damage, fire, floods, anomalies, or deficiencies in the accommodation, as well as the stay in general, and the provided services, the Client must immediately report to Casus Azorean Business employees, so that they can be resolved as quickly as possible.
  • Use Casus Azorean Business, accommodations, and spaces appropriately and carefully, taking responsibility whenever causing any damage to the accommodation.
  • Do not appropriate the belongings belonging to the accommodation unit.

 

10. RULES

  • The Client(s) must not use devices that may endanger the safety of people and facilities of Casus Azorean Business.
  • Smoking inside the accommodation, rooms, common areas, and lighting fires within the premises are prohibited. There are designated smoking areas.
  • Carrying a weapon or cutting instrument that may endanger one’s life or others is prohibited.
  • As a matter of respect and understanding for all guests, special attention is requested for silence in common areas. Noise production or activities that cause noise between 10:00 PM and 7:00 AM are not allowed.

 

11. DAMAGES AND LOSSES TO PROPERTY

The Client is obligated to indemnify Casus Azorean Business for any damages caused to the accommodation and/or its facilities/support areas, as well as damages arising from the breach of duties outlined in these Terms and Conditions, including attorney’s fees and legal costs.

 

12. COMPLAINTS AND COMPLIMENTS

Casus Azorean Business provides a complaints book and a compliments book.

 

LEGAL PROVISIONS

Unless otherwise stated, the software necessary for our services, available or used on our website, and the intellectual property rights (including copyright) of the content, information, and materials on our website are owned by Casus Azorean Business, its suppliers, or providers. To the extent permitted by law, these terms and conditions and the execution of our services shall be governed and construed in accordance with Portuguese law, and any dispute arising from these general terms and conditions and our services shall be submitted to the competent courts of Ponta Delgada, Portugal.
